Plaintiff Kelvin Moye has 'moved, pursuant to Rule 56, Fed.R.Civ.P., for partial summary judgment in this action. 1 Defendants Donald Selsky and Roland Cote (“defendants”) have cross-moved, pursuant to Rule 56, Fed.R.Civ. P., for summary judgment. For the reasons that follow, plaintiffs motion is granted and defendants’ motion is granted in part and denied in part.
