Stephen Lee Kirkland was convicted of driving under the influence of alcohol (“DUI”) by having an alcohol concentration of 0.10 grams or more, OCGA § 40-6-391 (a) (5), and of exceeding the maximum posted speed limit, OCGA § 40-6-181. He was acquitted of DUI to the extent that he was a less safe driver, OCGA § 40-6-391 (a) (1). He was sentenced to twelve months on probation with the first thirty days to be served in work release, eighty hours of community service, and two fines in the total amount of $1,200.
