OPINION

By WILLSON, District Judge.

In this diversity ease defendant has moved for judgment on the pleadings. Plaintiff Sam Colman is a resident of the City of Erie, Pennsylvania in this district. On November 8, 1956, according to the complaint, he was operating a Buick automobile owned by the other plaintiff, Rose Finglass, on a highway in Erie County, Pennsylvania. Defendant’s intestate, Robert H. Pitzer, Jr., a resident of Ohio, was operating a truck owned by him on the same highway. The vehicles collided. Plaintiff Colman was injured and as a result he claims damages in excess of *450$3,000.…
