Based on the briefs filed by the parties, this case appears to be identical to another appeal recently decided by this court, Ma rovec v. PMX Industries, 693 N.W.2d 779 (Iowa 2005). Just like the appellant in Marovec, the appellant in the present appeal, Maria Alvarez, claims she inadvertently failed to file an appeal brief within the time prescribed by agency rule in her intra-agency appeal of a deputy workers’ compensation commissioner’s decision on her claim for benefits.
