Tbe case under above title is in this court on appeal on questions of law by the Industrial Commission of Ohio, to secure a reversal of a judgment entered in the Court of Common Pleas against it and in favor of appellee.
The rejection of the claim by the commission was based upon the finding that appellee was not, at the time of injury, an employee of the claimed employer, the Scott Transportation Company, and this is the defense asserted in the lower court and here.
