Before the court is plaintiff’s motion to dismiss counterclaim. The court heard oral argument on June 27, 1994 and now rules.
I. BACKGROUND
Plaintiffs complaint states that in 1990, she applied for and received a credit card from J.C. Penney Company. When she was subsequently unable to pay her balance of $1,135.25, J.C. Penney assigned her account to defendant for collection purposes.
