This is an appeal from a judgment in favor of defendant and from an order denying plaintiff’s motion for a new trial, in an action brought to recover $134,-145 with interest.

The second amended complaint stated four alleged causes of action, all of which have been assigned to this plaintiff by the original owners. The first is a sample of all. One 0. L. Abbott was, on October 1, 1887, the equitable owner of 320 acres of land, and of “320 inches of water, miner’s measurement, incident thereto, constant and permanent flow from the canal of defendant.” Defendant held the legal title as trustee…
