This is a suit for damages which it is claimed that appellees, Nina C. Deaderick and her minor daughter, Frances Deaderick, sustained through the death of the husband of the former and father of the latter, Claude T. Deaderick, which, it was alleged, was caused through the negligence of appellant in permitting him to escape from the sanitarium, where he was confined for mental derangement, and the negligence of the receivers of the Texas Pacific Railway in running down and killing him while on its track.
