Simmons, Justice.

Logan was indicted and tried for the offence of assault and battery, and was convicted. He made a motion for a new trial upon numerous grounds, which was overruled by the court, and he excepted. It appears from the record that he was indicted by the grand jury of the city court of Savannah, and that when the ease was called finally for trial, he waived a trial by jury and consented to be tried by the judge of that court. Pending the trial the defendant moved to withdraw his waiver of jury trial, and demanded to be tried by a jury, but the court overruled the motion and…
