The appellant brought suit in an action of trespass for false imprisonment against appellee. It appears from the evidence that on the 30th day of October, A. D. 1879, the appellee came to the corn crib of the former while he was in his crib throwing back corn to make room for more. He was riding on a pony and was armed with a loaded revolver. The west side of the crib was on the east line of the highway, and the house of appellant, a few rods off, was on the west side of the road.
