—Appeal from a judgment of the County Court of Schenectady County (Sise, J.), rendered July 30, 1996, convicting defendant upon his plea of guilty of the crime of robbery in the second degree.

Defendant pleaded guilty to the crime of robbery in the second degree in connection with the May 1, 1996 armed robbery of a department store in the Town of Rotterdam, Schenectady County. Pursuant to his plea agreement, defendant waived his right to appeal and was sentenced to 5 to 10 years in prison.
