It is admitted that the following is a correct statement of the nature and result of the suit:
“This suit was originally filed on June 23, 1914, by Hubbeli, Slack & Co., appellant, in the Fifty-Fifth district court of Harris county, against A. M. Liddell & Co., to recover a debt, and was numbered 63447 on the docket of said court, and on July 16, 1914, and in the same case, a garnishment was sued out and on the same day served upon the Farmers’ Union Cotton Company, a garnishee; that on October 22, 1915, Hubbeli, Slack & Co., appellant herein, recovered a judgment against A. M. Liddell & Co.…
