This action was instituted by the “James River Bank, a Corporation, Insolvent, in Liquidation” as plaintiff. The complaint is, as follows:

“Comes-now the plaintiff in the above entitled. action, and for its cause of action against the above named defendant, alleges and shows unto the Court, as follows:
