Pending before the Court is defendant’s motion for summary judgment filed October 9, 1990, in the above-referenced action. After an initial round of briefing, the Court ordered the parties to address the narrow issue of whether an independent agent (Kaffka) becomes an agent for plaintiff under the facts of this case.
