Appellee sued appellant, an ice and cold storage company, a corporation, for damages for personal injuries alleged to have been received by him in the course of his employment in operating machinery at appellant’s plant in the city of Breckenridge.
Appellee alleges that while in the discharge of his duty he was injured in attempting to move a timber supporting one or two chain hoists, which timber was itself supported by two parallel horizontal joists, under and near the roof of the building in which plaintiff was working.
