ROSS, Circuit Judge.

This was a libel in rem against the American steamer Westport to recover damages for serious personal injuries sustained by the libelant upon the breaking and carrying away of the capstan of the steamer while he was serving as a seaman on board of her. The libel alleges that while the Westport was being warped alongside of the wharf at San Pedro, Los Angeles county, Cal., her master gave the libelant orders to take additional turns of the hawser around the capstan, and that libelant took two such additional turns as ordered, and that as he was about to leave the capstan it…
