BENHAM, Justice.

Gervaise Culmer appeals from his convictions of malice murder and theft by taking arising from the death of Patrice Peart. Culmer and Peart met in 1994 and began a relationship described by witnesses as turbulent. They eventually worked together in Atlanta where co-workers observed the deterioration of the relationship. Culmer was heard to threaten Peart’s life and was eventually dismissed from his job because of his attitude toward Peart and changes in his behavior at work. Phone records introduced at trial established Culmer called Peart from her apartment in the afternoon…
