MEMORANDUM OF DECISION GRANTING PLAINTIFF’S MOTION FOR SUMMARY JUDGMENT
TEMPLAR, District Judge.
On March 3, 1966 plaintiff filed its Complaint in Condemnation, seeking to acquire interests in a number of tracts therein described and which belonged to the City of Downs, Kansas, an incorporated municipality under the laws of the State of Kansas.
