MEMORANDUM AND ORDER
CROW, District Senior Judge.
This social security appeal comes before the court on the magistrate judge’s report and recommendation (Dk. 17) and the defendant commissioner’s objection to it (Dk. 19). The defendant does not object to the magistrate judge’s ultimate recommendation that the case be remanded for further consideration. The defendant does take issue with the magistrate judge’s statement of the legal standards governing the determination of a claimant’s credibility when she fails to comply with a physician’s recommended care or course of treatment.
