Appellant, Larry Floyd Barnett, was tried by a jury for the crimes of Murder in the First Degree, in violation of 21 O.S.Supp.1985, § 701.7, or in the alternative, Accessory to First Degree Murder, in violation of 21 O.S.1981, § 173, in Case No. CRF-86-480, and Arson in the Third Degree, in violation of 21 O.S.1981, § 1403(A), in Case No. CRF-86-479, in the District Court of Cleveland County.
