On March 29, 1996, the court entered a memorandum and order denying Mitcheal Edmonson’s petition for a writ of habeas corpus by a person in federal custody pursuant to 28 U.S.C. § 2241, construed as a motion to vacate sentence pursuant to 28 U.S.C. § 2255. See United States v. Edmonson, 922 F.Supp. 505 (D.Kan.1996). The court rejected Edmonson’s argument that the trial of his . friend and codefendant, Richard Lacey, in absentia in violation of Fed.R.Crim.P. 43 deprived him of a fair trial.
