This bill in equity is brought to enforce the defendant’s covenants in an indenture, executed by himself and the plaintiff on the 27th of October, 1865, upon the dissolution of a partnership previously existing between them under the name of Dean &-Emerson, and by which the defendant, in consideration of ten thousand dollars paid to him by the plaintiff, sold and assigned to the plaintiff “ all his right, title and interest in and unto the property, both real and personal, belonging to the copartnership aforesaid, including that branch of the business in which Horace M.
