This suit was started in the circuit court of Madison county, Illinois. The declaration consisted of two counts; one the consolidated common counts; the second or special count based on the grounds that the appellant did not perform the conditions in a certain stipulation in another case where the same parties were litigants. .Lewis L. Lindley owned the controlling interest in the Press-Becord Publishing Company, a corporation which published the Granite City Press Becord. On September 8, 1926, the appellee, E. E.
