The two cases presently before the Court raise similar questions of law and have been consolidated for purposes of briefing and argument.
In Civil No. 77-168-SD, plaintiff Brunswick School Board seeks declaratory and injunctive relief against the Secretary of Health, Education and Welfare (“HEW”), the Maine Commissioner of Educational and Cultural Services and the State of Maine.
