Appeal from special term, Westchester county. Action by the Anchor Brewing Company against the village of Dobbs Ferry for an injunction. The complaint was dismissed on the merits, and plaintiff appeals.

This action was brought to obtain an injunction restraining the defendant from maintaining and continuing sewers, culverts, and drains, which, it was claimed, diverted the natural flow of surface water, and cast it, together with sewage, in excessive volumes, upon the plaintiff’s property, and also to recover damages incident to such acts. The village of Dobbs Ferry was incorporated in the year 1873, and is built upon a hillside, which slopes to the west and south.
