ROUSE, J.

Allied Canners & Packers, Inc. (Allied) appeals from a judgment entered in its favor, following a trial to the court, in an action for damages for breach of two sales contracts. It contends that the trial court erroneously determined that it was a broker rather than a buyer under the contracts and therefore failed to apply the proper measure of damages specified in the California Uniform Commercial Code (Commercial Code).
