Judgment of the Supreme Court, Bronx County, rendered November 27, 1979, convicting defendant of robbery in the first degree (Penal Law, § 160.15) and robbery in the second degree (Penal Law, § 160.10), and sentencing him to two concurrent indeterminate terms of from 4 to 12 years, unanimously reversed, on the law, and a new trial ordered. The conviction in this case rested upon a positive identification of defendant as one of the two persons who robbed a taxi driver at gunpoint, certain circumstantial evidence and a statement which might be considered an admission.
