Mr. Judge LEDDY

delivered the opinion of the Commission of Appeals, Section B.

This cause was tried at the regular December term, 1928, of the district court of Young County, before Hon. E. G. Thornton, judge of the 30th judicial district. It was submitted to the jury on special issues, all of which were answered favorably to plaintiff in the court below. On the same day judgment in favor of plaintiff was duly entered in accordance with the findings of the jury.
