This is an action for personal injury, brought by Andrew Green, a coal miner, against the Western American Company, owner and operator of the Fairfax mines, Pierce county, Washington. Honsuit was granted by the court below, and the plaintiff appeals.

There were two general elements of negligence charged in the complaint — the employment of an incompetent pit boss, and the neglect of the defendant to furnish the plaintiff with timbers to properly timber his working place, as provided by § 3178, Bal. Code. The second amended complaint, charging…
