MEMORANDUM OPINION
MARK W. VAUGHN, Chief Judge.
The Court has before it Bank of New Hampshire, N.A.’s (“Bank’s”/“Defendant’s”) Motion to Dismiss (the “Motion”), which seeks dismissal with prejudice of Count I and stay or dismissal without prejudice of Counts II-IY of the complaint of the Official Committee of Unsecured Creditors (“Committee”/“Defendant”)- Based upon the record before it and for the reasons set out below, the Court denies the Bank’s Motion in its entirety.
