Appellant brought this suit in assumpsit in the circuit court of Kane county against appellee to recover $5000 insurance upon the life of Herbert A. Rose, her father. Her declaration finally contained eight counts, but the sixth (a consolidated common count) was withdrawn. The court sustained a general and special demurrer of appellee to the declaration, and appellant having elected, to stand by her declaration, judgment was entered in favor of the appellee.
