The plaintiff in error anl Marshall Roe, one of the defendants in error, will be designated as' defendants, and Elizabeth Roe, the other defendant in error, as plaintiff, in accord with their respective titles in the trial court. On July 27, 1910, plaintiff commenced this action, alleging, SO' far as material to this opinion, in substance and effect: (1) That she is the owner and entitled to be adjudged both the title and possession of the E. y<¿ of the N.
