The plaintiff, as administrator, commenced this action in the district court for Lancaster county to recover damages alleged to have been sustained by the next of kin of the intestate, Harry Draper, a minor, whose death was alleged to have been caused by the negligence of the defendants. The case is noAV before us for the second time. On the first trial the jury returned a verdict for the plaintiff for $1,000, and he had judgment.
