MEMORANDUM OF DECISION AND ORDER
SPATT, District Judge.
On May 7, 1999, the Plaintiffs commenced this action against Defendants Estelle Freedman (“Estelle”) and Frederick Fagelson, as executor of the estate of Robert Freedman to recover money under various theories of equity. Presently before this Court is Estelle’s motion for judgment on the pleadings, pursuant to Rule 12(c) of the Federal Rules of Civil Procedure.
BACKGROUND
