Kenneth Broome filed his petition for writ of habeas corpus against Walter Matthews, Superintendent of the Georgia Industrial Institute, at Alto, Georgia, alleging that he is being illegally restrained of his liberty by confinement at the Institute. His appeal from the judgment remanding him to the custody of the respondent, after hearing, is based on the contention that the evidence on the hearing showed that (1) he was sentenced upon a felony accusation without a jury trial, after entering his plea of not guilty, and (2) that he was not granted assistance of counsel for his…
