MEMORANDUM OF DECISION AND ORDER

This lawsuit arises from the claims of the plaintiff, Point Developers, Inc. (the “plaintiff’ or “Point Developers”) against the original defendant in this lawsuit, the Resolution Trust Corporation (“RTC”), as receiver for both State Savings, FSB, (“State FSB”) and State Savings, FA (“State FA”), based on an alleged breach of a loan agreement. On January 17,1996, the Federal Deposit Insurance Corporation (“FDIC”) was substituted for the RTC as the defendant pursuant to 12 U.S.C. § 1441a(m)(l). Point Developers contends that the RTC, as…
