Appeal from a judgment of the County Court of Franklin County (Main, Jr., J.), rendered May 27, 2014, convicting defendant upon his plea of guilty of the crime of driving while intoxicated.

Defendant pleaded guilty to one count of felony driving while intoxicated in satisfaction of a three-count indictment. Pursuant to the plea agreement, which included a waiver of appeal, County Court agreed to impose a split sentence of no more than five years of probation with 180 days in jail. The court thereafter sentenced defendant to five years of probation with the first 180 days to be served in jail…
