THIS CAUSE comes before the Court pursuant to Defendant Federal Insurance Company’s (“Federal”) Motion to Dismiss the Amended Complaint, filed May 5, 2003 [DE 50] and Defendant Continental Casualty Company’s (“CNA”) and Motion to Dismiss the Amended Complaint, filed May 22, 2003 [DE 53].
