OPINION

BUSSEY, Judge:

C. S. M., Jr., a juvenile, appeals from an order of the Juvenile Division of the District Court of Garfield County, Case No. JUV-79-16, waiving jurisdiction over him and certifying him to stand trial as an adult for the offense of Robbery With Firearms. First, the juvenile alleges the trial court committed error in failing to quash the summons and dismiss the petition on the ground that the summons was not issued within five days after the State assumed custody of the juvenile, as required by 10 O.S.Supp.1978, § 1104.1, ¶ (B).
