BACKGROUND
Plaintiff Catherine Evans commenced this action on behalf of her son, Frank, seeking declaratory and injunctive relief and alleging that defendant Rhinebeck Central School District Board of Education (“the District”) violated the Individuals with Disabilities Education Act (“IDEA” or “the Act”), 20 U.S.C. § 1400 et seq., and her civil rights under 42 U.S.C. § 1983, by failing to provide Frank with a “free appropriate public education” as required under the Act.
