Appeal and cross appeal from an order of the Supreme Court, Monroe County (Thomas A. Stander, J), entered July 27, 2004. The order denied defendant’s motion seeking summary judgment dismissing the complaint and granted in part and denied in part plaintiffs cross motion seeking summary judgment.

It is hereby ordered that the order so appealed from be and the same hereby is unanimously affirmed without costs.
