This is an appeal from the judgment of the Probate Court of Montgomery County overruling appellant’s motion to vacate the first and final account in the estate of Leon Sloane, deceased.
The appellant gave1 notice of an appeal on questions of law and fact. Obviously, an appeal on questions of law and fact could not be sustained. The appellant has proceeded as if the appeal were on questions of law, and the court will so regard it. The court •will, sua sponte, dismiss the appeal on questions of law and fact and retain the appeal on questions of law.
