Defendant appeals his conviction for murder. ORS 163.115. On appeal, he raises numerous assignments of error, one of which was resolved in the state’s favor in State v. Cunningham, 337 Or 528, 99 P3d 271 (2004). The Oregon Supreme Court remanded the case to this court for consideration of defendant’s remaining assignments of error. We reject without discussion most of defendant’s assignments of error and write to address three of them: (1) Whether the trial court erred in admitting the state’s DNA evidence; (2) whether the trial court erred in ruling that defendant’s DNA expert testimony…
