MOORE, Justice.

This is a suit by an insured seeking to recover on a fire insurance policy and in the alternative seeking damages against the insurance agency who issued the policy on the grounds of negligence.

At the time the fire occurred on April 27, 1975, plaintiff, Stan-Ann Oil Company, Inc. (hereinafter referred to as the “insured” or “plaintiff”), held a $75,000.00 fire insurance policy issued by Northern Assurance Company of America (hereinafter referred to as “appellant” or the “insurer”).
