This was an action brought by A. O. Wheelock against John E. and Augusta Myers to recover the amount of a promissory note on which there was due a sum exceeding $2000, and to foreclose a mortgage on land given by Myers and wife to the Rickert Investment Company. The mortgage and note were dated April 24, 1889. There was an allegation in the petition that the assignment of the mortgage to Wheelock was duly recorded.
