FORD ELLIOTT, P.J.:

¶ 1 Dale Edward Hart appeals from the order entered November 23, 2005, denying his first petition filed pursuant to the Post Conviction Relief Act (“PCRA”), 42 Pa. C.S.A. §§ 9541-9546, on the basis that ap*940pellant was ineligible for relief because he had served his sentence. We affirm.

¶2 On June 10, 2004, after a non-jury trial, the court convicted appellant of summary harassment, 18 Pa.C.S.A. § 2709(a)(1), in connection with an incident which occurred on August 28, 2008. On July 26, 2004, the trial court sentenced appellant to a 90-day term of incarceration. This…
