MEMORANDUM AND ORDER

GORDON, Chief Judge.

This matter is before the Court on the plaintiff’s motion for leave to file a supplemental complaint alleging violations of the Fair Credit Reporting Act, 15 U.S.C. § 1681, et seq. The defendant opposes granting the motion on the ground that the supplemental complaint fails to state a claim upon which relief can be granted and that therefore, granting the plaintiff’s.motion would be a futile act.
