This is an appeal by the plaintiff from an order denying plaintiff’s motion for a temporary injunction in a taxpayer’s action for an injunction under section 51 of the General Municipal Law, restraining the defendants, during the pendency of the action, from awarding a contract for the repair work of the ferryboat President Roosevelt, under the direction of the commissioner of plant and structures of the city of New York, for an amount exceeding $1,000, on the ground that the contract therefor is about to be let without open public competitive bidding, in violation of section 419…
