OPINION
CEDARBAUM, District Judge.
PacifiCorp Capital, Inc. commenced this diversity action against the City of New York and City official Joseph A. Messina to enjoin payment on a contract for the purchase of computer equipment from the International Business Machines Corporation (“IBM”). PacifiCorp seeks both a preliminary and a permanent injunction against the award of the contract to IBM, and asks for a permanent injunction awarding the contract to PacifiCorp based on its proposal of an Amdahl 5890-400E computer. All parties consented to IBM’s motion to intervene as a defendant.
