—Appeal by the de*652fendant from a judgment of the Supreme Court, Queens County (Flaherty, J.), rendered January 27, 1997, convicting him of murder in the second degree (two counts)., attempted murder in the second degree, robbery in the first degree, and criminal possession of a weapon in the second degree, upon a jury verdict, and imposing sentence.

Ordered that the judgment is modified, on the law, by reversing the conviction of intentional murder in the second degree and vacating the sentence imposed thereon; as so modified, the judgment is affirmed, and the matter is remitted to the Supreme…
